General Agreement

This document states the terms and conditions of using this site. By using this site and submitting to an order, you are agreeing to the terms and conditions listed below.

This site is operated and run by Avocano Group Pty Ltd, which reserves the right to amend this site and the terms and conditions at any time.

By registering and placing an order with Avocano Group Pty Ltd, you authorise us to add your contact details to our customer database. This will allow us to send through correspondence that relates to ordering, invoicing, shipping and product reviews and ratings.

You may choose to restrict the collection or use of your personal information at any time by taking the following steps:

Pricing & Taxation

All pricing is stated in Australian Dollars (AUD$) and is GST inclusive. All prices are subject to change without notice.

The current price of each product is shown on the website at the time the order is placed.

Avocano Group reserves the right to amend the prices of any product due to human error or a technical mishap.

Returns

When purchasing from Avocano Group and their websites please choose carefully. We do not normally provide refunds if you simply change your mind or make a wrong selection.

In the event where goods are faulty and cannot be repaired, wrongly described, different from a sample shown to you or don’t do what they are supposed to do you may choose either a refund or an exchange.

You must retain your original receipt as proof of purchase. All returns must be in original condition, unopened and unused (unless faulty). Returns must be made within 14 days of delivery, except when an item is faulty and covered by a warranty period.

It is the customer’s responsibility to retrieve any items that Avocano Group deem to be in unacceptable condition (unless faulty) or outside of the mentioned time frame. Avocano Group will not pay to return items in unacceptable condition or for items that the customer had a simple change of mind. Avocano Group takes no responsibility for lost items when sending returns, so we highly recommend that you send them via registered post.

Gift cards and promotional codes cannot be returned or exchanged and cannot be applied to exchanges. Once Avocano Group receives your returned item and deems it to be in an acceptable condition (unless faulty), we will happily refund or exchange it.

All clearance items are non-refundable, non-returnable or cannot be redeemed for credit purposes.

If a public customer purchases any professional products through Avocano Group or its distributors, although we do not recommend using trade products without technical knowledge, please be aware that you are purchasing at your own risk. Results may vary to what is desired. Avocano Group will not be held responsible and no refunds or credits will be given.

Warranties & Repairs

All warranties provided are solely the responsibility of the manufacturer and not Avocano Group. These warranties are offered directly by the manufacturer, who determines the specific warranty periods that may vary for each product.

Avocano Group has no authority over the warranty/repair periods set by the manufacturer, and therefore cannot provide precise information regarding their duration. However, Avocano Group is committed to expediting the process to the best of its ability and will keep you updated throughout. If the manufacturer deems that the faulty item cannot be repaired and is under warranty, Avocano Group will offer a replacement or refund.

Please note that Avocano Group cannot be held liable when you directly communicate with the manufacturer for repair or replacement purposes, or when the faulty item is sent directly to the manufacturer.

Trademark & Copyright

This site is owned & operated by Avocano Group Pty Ltd, and operates exclusively within the Australia & New Zealand markets. Any distribution of materials from this site, whether it be downloadable content, images or text. Must have the written approval of Avocano group. Any unlawful use of these materials may result in a breach of copyright or other related laws and may result in criminal charges.

Limitation Of Liability

Avocano Group is not responsible for any loss incurred by the use of this or any of its other websites or websites linked to this or these sites.

Disclaimer

Professional products such as Hair Colour, Bleach, Peroxide, Perms, Hair Relaxers or Chemical Straightening products are to be used by a fully qualified professional.

Avocado Group will not be held liable for the use of these products. Products must be in accordance with manufacturer guidelines. No responsibility will be accepted for misuse or incorrect selection of products.

Governing Law

This agreement will be governed by and constructed in accordance with the laws of the State of Victoria without regard to its conflict of laws.

Order Cancellations

If you wish to cancel your order and it has not been packed and/or shipped then we will be happy to accommodate. In the event that your order has been picked and/or shipped there will be a restocking fee of 10-20% depending on how big/complex the order was.

Avocado Group reserves the right to refuse any order cancellation, or a cancellation fee will be charged equal to the actual cost of shipping to and from the original order destination, in the event that the order has already been dispatched, and only if we are able to request the return of the package from the courier company.

Payment

All payments made on Avocano Group websites can be made through the following methods. Credit/Debit Card(Visa, Mastercard & American Express), Paypal, Afterpay & ZipPay. All credit card transactions will be made through the Paypal gateway and will have a pre-authorisation check to ensure sufficient funds are accessible and to confirm legitimacy of payment method.

All credit card transactions will state ‘Avocano Group Pty Ltd’ as the receiver of funds taken from this website on your bank statement.

Delivery

All freight charges are stated in the checkout and may change without notice. Orders are generally dispatched within 24-48 hours, depending on the quantity of orders in the system. All orders are packed on a first come first serve basis.

If there is a problem with your order and we cannot fulfil it within this time frame, Avocado Group will contact you using the contact details that were provided in the ordering process. Please ensure that you provide us with accurate and up to date contact details.

All delivery times stated on this site are estimated times only, and may vary. Avocado Group will not be held liable for any late deliveries or any losses, damages, expenses, charges, or costs that may arise from the late delivery. Once an order leaves our facility it is out of our hands. We cannot control how long a courier company will take to deliver an order.

On delivery, all orders require a signature before release of order. If you would like your parcel to be delivered without a signature, please check the Authority to leave checkbox at the end of the ordering process(see more information about Authority to leave below). Please note that In the event that you are not home and items are returned to the depot, Avocado Group reserves the right to on-charge additional freight costs incurred for the re-delivery of goods. Selecting this option ensures that you are aware of this.

Once the order has been released, you are responsible to check the order and inform Avocano Group of any damages or faults within a reasonable time period of  2 working days(not including public holidays).

Orders will be delivered to the Shipping Address that is stated in the Order Process. Please check this information is correct, as Avocano Group will take no responsibility for delivery to an incorrect address and/or any losses that may occur as a result.

Authority To Leave

If you are not home at time of delivery and wish to have your item left in a safe spot, you must select the ‘Authority to Leave’ option. Avocado Group will not be held liable for any damage, loss or theft by selecting this option. Please be sure of the risk of selecting Authority to leave and only choose this option if you know that there is a safe place out of public viewing.

This website may contain links to third party websites. Once you have selected these links and leave this website’s domain address. Avocado Group does not have any control over what happens over on these external websites.

This document only addresses activities on Avocano Group websites and on their web servers, this does not cover the terms and conditions of other websites, companies or people that Avocano Group does not own, control, manage or employ.

Submission Of Content

Any information that you provide to Avocado Group websites when using services that interact with you the customer, such as blogs, ratings/reviews and product recommendations may be displayed on Avocano Group websites. We kindly ask that you please consider any of these actions before you undertake and submit them online. As these will be visible to the public and you might not want this information out in that domain.
